Hello Delivery Customer Terms of Service

These Terms of Service ("Terms") govern your use of the delivery service operated by Hello Wellness LLC ("Hello Delivery," "we," "us," or "our"). By placing an order, you agree to these Terms.
1. Eligibility
You must be at least 21 years of age to use the Service. We verify age and identity via government-issued photo ID at every delivery, with no exceptions.
2. Service Area and Hours
Deliveries are available daily from 8:30 AM to 10:00 PM. Orders placed outside these hours will not be processed until the next available window.
3. Orders and Pricing
- A $30 minimum order applies to all orders.
- A delivery fee applies and will be clearly shown at checkout before you complete your order.
- Estimated delivery time is generally within one hour of order placement. Delivery times may run longer between 4:00 PM and 7:00 PM due to demand.
4. Payment
- We accept cash, Bitcoin, and card.
- Card payment is unlocked only after your account has been approved.
- Cash payments require exact change — couriers cannot make change and cannot accept IOUs.
- Tips are optional and never required.
5. ID Verification
Every delivery requires a valid, government-issued photo ID check at the door, regardless of prior orders or account history. Delivery may be refused if ID cannot be verified or does not confirm you are 21 or older.
6. Cancellations
Orders may be cancelled within the first 5 minutes of placing the order at no charge.
Cancellations made between 5 and 59 minutes after ordering are subject to a $10 cancellation fee.
If your order has not been delivered within 60 minutes of placing it, you may cancel at no charge, as we did not meet our delivery window. Between 4:00 PM and 7:00 PM, this no-fee cancellation window extends to 90 minutes due to rush hour demand.
7. Courier Wait Time
If a courier arrives for delivery and must wait more than 5 minutes for the customer, a $10 wait fee will apply.
8. Refunds
Refunds are considered case-by-case, at Hello Delivery's sole discretion. Submitting a refund request does not guarantee a refund will be issued.
9. Checkout Consent to Fees
By completing checkout, you acknowledge and agree to the delivery fee, minimum order requirement, and potential cancellation and wait-time fees described in these Terms.
10. Conduct
You agree to be present, reachable, and prepared to present valid ID at the scheduled delivery location. Abusive, threatening, or unsafe conduct toward couriers may result in account suspension or termination.
11. Disclaimers and Limitation of Liability
The Service is provided "as is." To the fullest extent permitted by law, Hello Wellness LLC disclaims all warranties and is not liable for indirect, incidental, or consequential damages arising from use of the Service.
12. Dispute Resolution — Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
You and Hello Wellness LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Service, or your relationship with Hello Delivery will be resolved by binding individual arbitration, and not in court, except as set out below.
- Arbitration administrator and rules: Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect.
- Class action waiver: You and Hello Wellness LLC agree that any arbitration or claim will be conducted only on an individual basis and not as a class, collective, or representative action. Neither party may bring a claim as a plaintiff or class member in any purported class, collective, or representative proceeding.
- Small claims exception: Either party may bring an individual claim in small claims court instead of arbitration, if the claim qualifies.
- Opt-out right: You may opt out of this arbitration agreement by sending written notice to support@gethello.delivery within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.
- Severability: If the class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) may proceed in court, while all other claims remain subject to arbitration.
- Governing rules for arbitration itself: The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
13. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles.
14. Changes to These Terms
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
